1. Acceptance of Terms

By accessing or using Banana 2 Lite ("Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, discontinue use immediately.

2. Service Description

Banana 2 Lite is a Next.js-based AI image workbench offering text-to-image, image editing, batch generation, credit-based billing, subscription plans, history tracking, Cloudflare R2 storage, Resend notifications, and analytics. The Service may use third-party AI models such as Kie.ai's Gemini 2.5 Flash Image Preview. We may embed invisible watermarks or tracking signals in generated assets to help enforce licensing compliance.

3. Eligibility & Accounts

You must be of legal age and have capacity to contract. Organizations must ensure authorized representatives. Accounts are personal and non-transferable. You are responsible for all activities performed under your credentials, including API usage and credit consumption, and must maintain accurate information.

4. Acceptable Use

This Section 4 serves as our Acceptable Use Policy for all AI generation, editing, and storage features.

When using the Service you agree you will not:

• upload, request, generate, edit, store, share, or distribute illegal, infringing, hateful, violent, privacy-invasive, or sexual content, including any NSFW, sexually explicit, pornographic, nudity-focused, fetish, erotic, exploitative, or otherwise adult sexual content;
• submit prompts, reference images, or other materials intended to create sexual content, sexual nudity, sexual gratification content, or any content involving minors in a sexualized context;
• attempt to bypass, test, probe, or reverse engineer any content safety, moderation, or abuse-prevention controls;
• violate any applicable law or third-party right;
• run spam campaigns, malware, phishing, or any automated abuse (bots, crawlers, scripted calls) that could disrupt operations;
• attempt to access non-public areas, reverse engineer, or bypass security/rate limits;
• misrepresent your identity or relationship with any entity;
• resell, transfer, or commercialize access without permission; or
• upload viruses or other malicious code.

You must own or have rights to all prompts and reference materials you submit and remain responsible for reviewing outputs before distribution.

5. Content Review & Enforcement

We reserve (but are not obligated to exercise) the right to:

• automatically screen prompts, reference images, metadata, and outputs for suspected policy or legal violations, and block, hold, refuse, remove, or disable related generation requests or content;
• monitor the Service for content or behavioral violations;
• remove or refuse to display content we believe breaches these Terms;
• suspend or terminate access for users who violate the Terms or repeatedly attempt to evade our safety systems; and
• cooperate with law enforcement regarding unlawful activity.

6. Plans, Fees & Credits

Key billing rules:

• Plans include monthly/yearly subscriptions and one-time credit packs.
• Credits are deducted per task based on model, size, or quantity; pricing may change.
• Charges are in USD plus applicable taxes and auto-renew unless cancelled before the next cycle.
• Payments and consumed credits are non-refundable except where required by law.
• Credits may expire or be forfeited and will not be reinstated once lapsed.
• Payments are processed via providers such as Creem, Stripe, or PayPal. You authorize us and them to charge your stored method.
• Cancellation or downgrade requests must be submitted via your account dashboard or support before renewal.
• Any discretionary refund follows the published Refund Policy (if any), which may set usage limits or time windows.

Commercial Usage & Licensing

Free or non-commercial plans only permit personal use of generated assets. Commercial licenses are granted automatically once you subscribe to an eligible commercial-tier plan and must follow plan-specific limits. Unauthorized commercial exploitation may lead to account termination, credit forfeiture, or legal action, and we may rely on embedded watermarks when investigating.

7. User Content & Outputs

You retain ownership of submitted materials but grant Banana 2 Lite a worldwide, non-exclusive, royalty-free license to process them to operate, improve, and comply with the Service. Specifically:

• we do not use your uploads or generated outputs to train models beyond what is necessary to fulfill the request unless you opt in;
• you may use AI outputs subject to these Terms and third-party rights; and
• we may analyze data in aggregate/anonymized form for debugging, abuse prevention, or product improvement and may remove violating content.

8. Third-Party Services

Core functionality relies on providers including Creem, Stripe, PayPal, Cloudflare R2, Resend, Google Analytics, and Kie.ai/Gemini. Availability, pricing, and policies may change. You authorize us to transfer information to these providers as necessary. We are not liable for delays or interruptions caused by third-party failures.

9. Data & Privacy

Personal data is processed according to our Privacy Policy and includes, at minimum:

• account profile information and authentication data;
• prompts, reference images, generation history, and associated metadata;
• payment records, invoices, and billing communications;
• device/browser identifiers, cookies, and analytics events; and
• support tickets or emails.

By using the Service you consent to necessary cross-border transfers. You may exercise data rights via support@banana2lite.com.

10. AI Disclaimer

AI outputs may contain errors, bias, or content that is inaccurate or unsuitable. The Service is provided "as is" without warranties of uninterrupted operation. You assume all risk for reviewing and using generated content and must ensure compliance before distribution.

11. Suspension & Termination

We may suspend or terminate accounts for violations, non-payment, abnormal usage, legal requests, or security concerns, and may delete or preserve data as needed. You may close your account at any time but remain responsible for outstanding fees. We may retain necessary logs after termination as permitted by law.

12. Indemnification & Limitation of Liability

You agree to indemnify and hold Banana 2 Lite, its affiliates, and partners harmless from claims arising from your use, outputs, or violations. To the extent permitted by law, we are not liable for indirect, consequential, or punitive damages. Our aggregate direct liability is limited to the fees you paid during the billing cycle preceding the event.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to conflicts of law rules. Before filing any claim, you agree to email support@banana2lite.com and attempt to resolve the dispute informally within 30 days. If unresolved, the dispute must be submitted to binding arbitration (or the specified court) on an individual basis; class or representative actions are waived to the extent permitted by law. Mandatory consumer rights remain unaffected.

14. Ancillary Legal Terms

These Terms constitute the entire agreement between you and Banana 2 Lite regarding the Service and supersede prior agreements. If any provision is held invalid, the remainder remains in effect. You may not assign these Terms without our consent; we may assign them without restriction. Our failure to enforce a right is not a waiver. Notices may be delivered by email or by posting within the Service.

15. Changes to Terms

We may update these Terms at any time by posting revisions with the effective date. Material changes will be communicated with reasonable notice. Continued use after the effective date constitutes acceptance; otherwise, discontinue the Service.
